Abstract of Will of Thomas Cogan dated 31 Oct. 1580, prov. 16 Nov. (PCC.46 Arundell)
Burial in the church of the parish where he dies. To brother RobertCogan, 4 Pounds per annum out of leases. If son Robert Cogan dischargehid debts and "live civellie and orderlie," then he is to have 100 poundspaid by executors. To daughter Margaret Sellwoode, wife of PhilibarteSellwoode and assigns 24 pounds per annum to be paid out of part ofParsonage, Rectorie, and "Sheafe of Martocke," co. Somerset, nowheld forvarious leases, during all such leases, and income therefrom. He releaseshis son-in-law Philebarte Selwoode, from all debts and duties due. Tosons Thomas and Philebarte Cogan, all other leases divided equally. Deedsthe of are to remain in a locked chest with two keys and lockes, eachofthem to have one key. "Touching the discharge of my conscience," hebequeathes to John Davyes "who dwelt sometime at Byckinton near FromeSelwoode, or to his children if he is dead, in recompense of all causes"8 pounds. To Henry Lopus of Chagforde, co. Devon, or his successors, 10Pounds. Robert Wollmington of Charde is to pay all debts and charges due:12 pounds and "the charges of suite to be clearly discharged." The debtof Henry Samwaies of Chard is reduced from 12 pounds to 5 pounds. The twoQuintrells are to pay for all debts due the sum of 8 pounds. To on Busley10/-; to one Flodde 1/-; to two Bowbyes 20/- each. To Mr. Willes ofSaltashe, co. Cornwall, 10 pounds or 10 pounds 'which I supposed wasaccompted to. Prestewoode of Exeter 17/-; to Mr. Nicholas Martyn, for Mr.Hurste, 13/4; to Mr. Richard Irishe for cloth be recompenced for certaintynne which I bought of him, and if unpaid, which my will is it shall beso done." To Mr ____bought about 20 or 30 years past 20/-. To the poor ofCharde and the parish 10 pounds to be divied. To one Smyth 'that dwelt inthe latter place, in recommpence of old debt" 20/-. [9247] JOHN MARSHAL, the founder of this family, owed his political advancement to his near relationship to William Marshal, Earl of Pembroke (b), and his feudal position to his marriage with Aline, eldest daughter and coheir, and afterwards sole heir, of Hubert IV de Rye, lord of the baronyof Rye (c). John Marshal first appears on the page of history in 1197, as one of the knights, under command of William Marshal, sent by Richard Ito assist the Counts of Flanders and Boulogne against France. In 1203 hewas in Normandy with King John, and in the following year went to Irelandin the service of the Earl Marshal, while the Earl went to Normandy in the service of the King. On 12 November 1207 he was made Marshal of Ireland. He accompanied King John on his Irish expedition, 1210. From1213 to the end of the reign he was constantly occupicd in the King's service in England; in 1215 he was with King John at Runnymede, and oneof those by whose advice the King gave his assent to Magna Carta; laterin the year he was one of the embassy to the court of Rome. Returning, he accompanied the King on his march to the North, and attended him at his death at Newark, 19 October 1216. Nine days later he was present at theCoronation of Henry III at Gloucester, and was a member of the council ofhis uncle, guardian of the young King. He was among the "barons" in theEarl Marshal's forces in the relief of Lincoln Castle. From this timetill his death he was continually occupied in the public service in England, Ireland, or abroad.

He married, about 1200, Aline, eldest daughter and coheir of Hubert DERYE, by Margaret, daughter of William FitzRocelin. He died before 27 June1235. His widow did homage on 6 July for the lands she held in chief. Shedied between June 1266 and September 1267. [Complete Peerage VIII:526-7,(transcribed by Dave Utzinger)]

(b) John Marshal gave land in Foulsham, Norfolk, to the priory of Walsingham, for the souls of himself and his wife Aline, for John andAlice, his father and mother, for William, Marshal of the Earl, and Isabel, his wife, and for Hubert and Margaret de Rye. William Marshal's elder brother John (whose heir he was) died in 1194, leaving a widow, daughter of Adam de Port. John is described in a charter of King John as'nepos Willelmi Marescalli comitis de Pembroc' [nephew of William Marshal Earl of Pembroke]. The very detailed biography of the Earl Marshal (Guillaume le Marechal) cited above makes no mention of a second brotherJohn, and the Earl's nephew appears to have had no patrimony; it is therefore probable that he was an illegitimate son of the Earl's elder brother.

(c) The caput of the barony of Rye, which took its name from its owners,descendants of Hubert de Rye (Ryes, near Bayeux), was at this date at Hingham, though Hingham was only held at farm from the Crown. Later Hockering became the caput of the barony, though Hingham was still in possession.
