Defendants motion to quash warrant, plaintiffmoves to ammend warrant by inserting "whereas James Ashmore has given information to me the subscriber a Justice of the peace for said county, that Absolom Borin on the (blank) day of (blank) 1809 at is what is now the county aforesaid took up a certain stray sorrel mare at a place other than on his own land, contrary to an act of assembly, in such case made and provided, you are therefore commanded to summon the said Absolom Borin to appear before me, or some other Justice of the Peace for said county, to answer the said James Ashmore in a plea of debt of twenty dollarsand C, to which the defendant by his attorney objected. Defendant recovers against plaintiff his costs; trial postponed until next term of this court.
