M. Mary Brown, of Sudbury, about 1662, and resided there.
May 23, 1685, Benjamin Rice, of Sudbury, sued Dr. William Avery, ofBoston, for malpractice. Verdict for defendant. In that suit, DanielPond testified that, "ten years ago, Benjamin Rice, of Sudbury, came tomy house, in Dedham, with his feet frozen, and lodged there. Dr. WilliamAvery's son, Benjamin, cut off one foot at the lowest joint, and stanchedthe blood with a musquash skin." Dr. William Avery does not appear, bythe evidence in the case, to have been present at the operation. Themalpractice, if any, was therefore not chargeable to him, but to his son,Benjamin:- hence the verdict.
