Walter Woodworth was born in England, about 1610 according to Colket, or 1612 according to Behan. He was at Boston in 1634.
Behan says that Walter may have indentured himself for a time to pay his passage expenses, as the records mention Walter as having "come as a servant" to Plymouth Colony. Plymouth Court Records of 2 January 1633/1634 order "that whereas by indenture many are bound to give their servants land at the expiration of their terms, it is ordered that they have it at Scituate or some other convenient place, where it may be useful." There is no record of his passage.
He first appears on the records on a list of taxpayers in Plymouth Colony, made between 2 January 1633/1634 when the tax "for publick use" was ordered, and 27 March 1634, when the list was presented to the Court. Walter's name falls near the end of the list, and he is taxed at nine shillings. It is assumed he was still a single man without house or property, but not now a servant.
Walter came to Scituate MA in 1634/1635, where he settled among the "Men of Kent". He was assigned for a house lot the third lot on Kent St., which runs along the ocean front, at the corner of Meeting House Lane. He also owned a tract on the First Herring Brook not far below Stockbridge Mill, where afterwards stood the residence of poet Samuel Woodworth; and another tract on Walnut Tree Hill, which was in early times called Walter Woodworth's Hill. In 1666 he purchased 60 acres at Weymouth.
In 1640 Walter was assessed nine shillings for the public use. On 2 March 1641 he was made freeman.
On 4 June 1645 he was appointed surveyor of highways in Scituate, which office he held in 1646 and 1656 also. As Surveyor of Highways he was responsible for laying out and maintaining the town's roads. Most towns had several surveyors, each responsible for the roads in the section of town in which he lived. Additionally, each Surveyor was responsible for calling out and supervising the two days of work on the roads which was required annually of each of the town's inhabitants.
His name appears frequently on the town records of Scituate as juror, witness, and in the performance of other public duties.
Walter was a member of First Church in 1654 when it ordained Charles Chauncey as its minister. On 13 July 1654 he signed by mark a deed for church land.
When his next door neighbor, Japhet Turner, in 1661 pulled down Walter's fence and obliterated his boundary lines, Walter promptly sued him and obtained a verdict for L5 and costs.
On 3 June 1662 lands were granted at Seconett Neck (later Little Compton RI) to "such that were servants and others that are ancient freemen."
In June 1665 the Plymouth Court requested that the townsmen of Scituate appoint Cornett Studson and Walter Woodward to assist in settling a boundary dispute of William Randall.
By the late 1650s Walter's name was occasionally entered as Woodworth rather than Woodward. Walter himself could not write and signed by mark, so he had little control over it. His name is spelled Woodward throughout his will, but his son Benjamin signed the inventory as Woodworth.
His wife's name is not on record, and the births of his children are not recorded in Scituate. The dates of the children's births differ widely in different sources; I have used primarily the dates given by Behan, which follow the order in which the children are named in their father's will. Savage, Deane, and the two older Woodworth genealogies make no mention of Walter Woodworth's will; only Behan's 1988 genealogy has that quality of supporting documentation.
Savage and Deane include an eldest son, Walter, who resided at Scituate, and left children Mary b. 1658, Mehitable 1662, and Ebenezer 1664. Neither Walter nor his heirs are mentioned in the father's will, however, and Thomas is called the oldest son there. There was a Walter Woodworth at Little Compton, but he has not be proven to be the son of this Walter.
The will of Walter Woodworth of Scituate is dated 26 November 1685, and signed by mark. The will was probated 2 March 1685/1686. It makes bequests:
- to Thomas Woodward, oldest son, upland lying in Scituate
- to sons Thomas and Joseph, marsh land at Scituate, equal shares
- to son Thomas Woodward, 1/3 of land at Seconet
- to sons Benjamin and Isaac, equal shares of the other 2/3, except 25 acres to son Joseph, and 10 acres to daughter Martha.
- all the rest of the land purchased at Seconet to be equally divided between sons Thomas and Joseph.
- to son Benjamin, my dwelling house, barn and out housing, all my upland and marsh land; 20 acres of upland, six acres of marsh land, the commons and privileges thereunto belonging. Benjamin to pay L70 to my son Joseph and my six daughters: Sarah, Elizabeth, Mary, Martha, Mehitable and Abigail L10 apiece. Benjamin to allow my two daughters Mehitable and Abigail the lower room or parlor at the northeasterly end of my dwelling house for their use during the time that they live unmarried.
- to daughters Mehitable and Abigail my feather bed with the furniture thereunto belonging, and all the rest of my household goods to my six daughters in equal shares. The rest of the estate after expenses to the children in equal shares, Benjamin being sole executor, and Joseph and Thomas overseers.
